- Next of Kin details, including any support networks
- GP (General Practitioner)
- Health information (including medical conditions, allergies, medical requirements, and medical history)
- Information about care needs (including disabilities, home conditions, medication, dietary requirements, and general care provisions)
- Payment details (including card or bank information for transfers and direct debits)
- Records of meetings and decisions

## Our Lawful Bases for the Collection and Use of Your Data
Our lawful bases for collecting or using personal information to provide patient care, services, pharmaceutical products, and other goods are:
- Consent
We have permission from you after providing all relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.
- Contract
We have to collect or use the information so we can enter into or carry out a contract with you.
- Legal obligation
We have to collect or use your information to comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object, and the right to data portability.
- Legitimate interest
There is a duty of confidence when clients share their information in confidence, and your information will not be disclosed unless there is some form of legal authority or justification.
- I am bound by the British Association of Behavioural and Cognitive Psychotherapies (BABCP) Standards of Conduct, Performance, and Ethics as well as by the Code of Conduct. A copy of the BABCP Standards is available if required.
- At our initial meeting(s), we will work together to identify the problem or issue that you would like help with. I will ask you about the problem(s), how they trouble you, and when and how they started, as well as any other treatment or support you have had or are having now. This may take one or two meetings.
- At the end of this period (the assessment), we will agree on your goals for therapy, decide if I am likely to be able to help you, and if you would like to continue working with me. You will be under no obligation to continue working with me.
- If we agree to work together to address your goals, I will initially offer you a specific number of sessions to address the problems identified as suitable for CBT (Cognitive Behavioural Therapy) treatment.
In addition, your personal information, such as your contact details (telephone and email address), will be used to assist in the administration of our work to provide you with an effective service. I would like to use your contact details to assist with the administration of your appointments, changes to scheduled appointments, and/or reminders about appointments. To further enhance the service provided to you, I would like to be able to update you on any information regarding the practice.

## How Long We Keep Information
All reasonable steps will be taken to respect your rights to privacy. Your data will be stored electronically on a secure password-protected computer system, in accordance with the Data Protection Act and GDPR regulations and guidelines.
You can request a copy of the data held about you by submitting a Subject Access Request.
There is a legal requirement to keep medical records for a period of seven years. After this period, your data will be destroyed.

To protect you as my client and to ensure safe and ethical practice, I am required to have continued training and engage in regular supervision. Therefore, I may discuss your case in supervision. I would not use any identifying details. My supervisor will also be bound by the Code of Practice and confidentiality.

### Duty of Confidentiality
We are subject to a common law duty of confidentiality. However, there are circumstances where I will share relevant health and care information, but I will endeavour to discuss these circumstances with you in the first instance. These include:
- Where you’ve provided me with your consent
(It is taken as implied to provide you with care, or you have given me explicit consent for other uses).
- Where I have a legal requirement to collect, share, or use the data
For example:
- When Court orders are issued.
- When someone’s physical or mental health or wellbeing is at urgent or serious risk.
- When there is a risk of harm to yourself or others, such as a child or vulnerable adult.
In such cases, I am obligated by law to share information with other health providers, such as your GP or Emergency Services.
- On a case-by-case basis, where the public interest to collect, share, and use the data overrides the public interest served by protecting the duty of confidentiality
(e.g., sharing information with the police to support the detection or prevention of serious crime).
- If in England or Wales
The requirements of The Health Service (Control of Patient Information) Regulations 2002 are satisfied.
- If in Scotland
We have the authority to share provided by the Chief Medical Officer for Scotland, the Chief Executive of NHS Scotland, the Public Benefit and Privacy Panel for Health and Social Care, or other similar governance and scrutiny processes.
